Terms and Conditions:

Cheeky Foods will use its best endeavours to list products with the most competitive prices and reserves the right to change prices for products displayed on the Cheeky Foods site at any time.

Our products are sourced from within Australia and international markets and as such some may not be available for sale in Australia.

This means that there may be no Australian recommended retail price for some products.

Where we have been able to establish that a product is for sale in the country, we have used that products market price as the recommended retail price.

Please notice that the prices showing on this website do not apply for Wester Australia

 

  • Frozen and refrigerated products will be dispatched between Mondays and Wednesdays to allow time to get to destination between Wednesday and Friday. (No weekend delivery available)
  • Frozen and refrigerated products will be placed polystyrene containers and should be placed in the freezer / fridge as soon as they arrive.
  • Once products are thawed must be stored refrigerated and consumed within 3 to 4 days, or accordingly to each product storage instructions. (Please refer to product label)

These represent the Terms and Conditions for using this service. If you do not agree to these, then you may not use this Website.

You are permitted to use our website solely on the basis of these Terms and Conditions.

We reserve the right, at our discretion, to update and/or revise these Terms and Conditions. Please check periodically for changes.

To register with cheekyfoods.com.au and purchase goods from our Website you must be over 18 years of age. You must ensure that the details provided by you on registration or at any time are correct and complete. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details. You must give us your real name, address, phone number, email address and any other details that we may require to process your order.

 

Registration and Contract

'ZAYME PTY LTD' means Zayme Propriety Limited trading as Cheeky Foods. You are the customer. You agree to purchase services and goods from Zayme Pty Ltd subject to these Terms and Conditions which will apply to all transactions using our service.

You must be 18 years or over and must complete the registration procedure to participate in our grocery service online portal.

By registering for this service you agree that the details provided by you on registration, or at any time, are correct and complete. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details. You must give us your real name, address, phone number, email address and any other details that we may require to process your order.

Your email address is essential in order for us to be able to supply you with important information such as order confirmations, and changes to the service. By registering with our grocery service online portal, you accept that your email address may be used to supply you with such information.

Customers using our service accept the need to have their credit or debit card details registered with PayPal prior to ordering. These details are held by PayPal and not by Zayme Pty Ltd including the PayPal password that is different from the one at cheekyfoods.com.au website or Zayme Pty Ltd.

It is your responsibility to keep your passwords secure. We reserve the right to modify or withdraw a password at our discretion.

We reserve the right to:

• Decline a new customer registration or suspend or terminate a customer’s account at any time and at our sole discretion.

• Zayme Pty Ltd reserves the right, in our absolute discretion, to terminate your access to all or part of the services with or without notice.

• Zayme Pty Ltd reserves the right in our absolute discretion to discontinue the Website or services, or any part thereof, at any time, with or without notice.

We will not be responsible for any loss or damage caused to the goods after the goods are received.

 

Availability

Goods are subject to availability. If for any reason beyond our reasonable control we are unable to supply a particular item, we will not be liable to you except to ensure that you are not charged for that item. A full refund will be given where you have already paid for the goods.

Bulk purchase

To ensure availability of all our products, customers may be limited to a maximum number of items. Goods will not be supplied for the purposes of resale, and are only supplied for a customer’s own use as a consumer. We reserve the right to refuse orders that we consider are for commercial or non-domestic purposes or subject to onward delivery by a third party.

 

Pricing, descriptions and product information

The prices which you must pay for the products that you order are set out on the Website at the time you place your order (plus a delivery charge) except where we discover an error in the price of the products you have ordered. In this event, we will inform you as soon as possible after receiving your order and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled.

All prices are shown in Au$ Dollar and inclusive of GST

Although we will take all reasonable care to ensure that all descriptions, details and prices of products appearing on the Website are correct at the time when the information was inputted onto the system, the information appearing on this Website at any time may not reflect the exact position at the moment you place an order.

Please be aware that the colours and appearance of our products may vary slightly from the way they appear on the screen and we cannot guarantee that your monitor screen will accurately reflect the colour of the product on delivery. All measurements and sizes are approximate, although we make every effort to ensure that they are as accurate as possible.

The weight of some goods may vary marginally from that ordered and the price may change to reflect actual weight - if it weighs a little less you pay a little less and if it weighs a little more you pay a little more. Prices in ‘My Cart” are estimates only.

 

Placing an order and order acceptance

The order acknowledgement email and order number are not an order confirmation or order acceptance from us. Acceptance of your order and the completion of the contract between you and us will take place on despatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it. Where items are despatched separately, our acceptance of the order in respect of each item takes place when that item is dispatched. For items delivered to you by a carrier, legal acceptance of your order will be when the carrier schedules a delivery with you. Our carrier will make every reasonable effort to contact you to make delivery, but if they are unable to do so then your order will be cancelled and payment refunded to your card.

There is no minimum order value on any grocery order. All orders below Au$50 are subject to a standard delivery charge, which includes selecting, packing and delivering the goods.

We are not permitted to sell alcohol.

 

Payment

We take payment from you through PayPal. You must register to PayPal in order to use this service. PayPal is responsible for the transaction with your bank. We do not deal with any information with your credit or debit card.

Any refunds will be processed through PayPal as soon as they are accepted by the company accordingly to the refund policy.

Shipping Policy

PLEASE NOTE: The return information listed below is for consumer (or “individual”) customers only. This does not apply to wholesale accounts.
In-stock orders ship within 2-3 business days. We do not process orders on Thursday, Friday or weekends, so orders placed on Thursday and Friday usually ship out on Monday. Orders placed on holidays will begin processing the next business day. No weekend or holiday delivery is available. All stock orders ship from our warehouse in Melbourne VIC. Orders placed after 12:00pm are typically processed the following business day. We currently do not ship to PO Boxes. You will be notified if there are any out of stock items and its expected receipt date. All orders will be shipped via courier.

We deliver to mainland in Australia only to QLD, NSW, SA, ACT and VIC addresses. We cannot deliver to any other state as this stage (if you live in a regional area is best to check with us if we can deliver the goods prior making the order). We reserve the right to charge to deliver to certain areas, post codes or when the order exceeds the limit weight amount.

Delivery areas, dates and times are subject to availability.

Some areas within these states may not be available for delivery. If that is the case, we will notify you by email of phone call and your money will be refunded.

Zayme Pty Ltd t/a Cheeky Foods reserves the right to withdraw this delivery offer at any time.

Provided that we have processed and received payment in full for the products, ownership of an item will pass to you once we have delivered the item to you. When an item has been delivered, risk of damage to, or loss of, the item passes to you. You must ensure the storage of the product accordingly to the type of product.

Frozen products will be delivered in polystyrene containers and should be placed in the freezer as soon as they arrive. Once products are thawed must be stored, refrigerated and consumed within 3 to 4 days or accordingly to each product storage instructions.

By placing an order you are authorizing us to accept signature from another person at the same address on your behalf if you are not present at the time of delivery.

Zayme Pty Ltd t/a Cheeky Foods will be under no liability for any delay or failure to deliver the products within estimated timescales.

It is your responsibility to ensure you check the space available in your fridge, freezer or storage for the product before placing your order.

Where requested by the delivery driver, products must be inspected upon delivery and refused if any damage is found.

Failure to notify us of any visible damage may result in claims not being accepted if the item has been signed for. Damage should be notified to the driver and noted on their delivery pad at the time of refusal.

You must not use a product that is damaged or different to that, which was ordered. Failure to comply with this will deem that you have accepted the goods and will be unable to return them because they are damaged or different to that ordered. Your statutory rights are not affected.

We reserve the right to restrict or refuse delivery requests in certain areas at any time and without notice.

We deliver your order to the front door of your house or to the communal entrance to your block of flats.

Our delivery service does not include a detailed check of your shipping. However, if you have any queries, please email us at contact@cheekyfoods.com.au after your delivery has taken place.

If your delivery is going to a work address, we will always deliver to the ground floor communal entrance of your business’ building then contact you to meet our driver. We reserve the right to return your order if you do not come to collect your order within a reasonable time. In this instance, we reserve the right to charge for any re-delivery.

Deliveries will be made Monday/Tuesday/Wednesday/Thursday/ Friday of each week. However, orders will only be processed on Monday/Tuesday/ Wednesday. If we anticipate any difficulties concerning the delivery date, we will contact you to arrange a mutually acceptable alternative.  

Under no circumstances order of frozen products will be processed or dispatched on Thursday or Friday.

When your item has been shipped we will send you an email confirming your shipment and provide you with your tracking number.

Refused Shipments

If you decide to refuse any shipments from cheekyfoods.com.au, you are responsible for the original shipping charges to you, (on both the original and return shipments), and the cost of returning the package to cheekyfoods.com.au. This amount will be subtracted from your credit card.

Cancellation, returns and refunds

  • Your right to return does not apply to perishable products unless the goods are faulty.
  • All refunds will be made to the PayPal account on which the original purchase was made within 30 days.
  • Your statutory rights are not affected.

 

Vouchers and promotions

Vouchers can only be used on this Website subject to these Terms and Conditions.

Vouchers are, and remain at all times the property Zayme Pty Ltd. The right to use a voucher is personal to the original or named recipient and may not be transferred without permission. It may not be copied, reproduced or published either directly or indirectly. Vouchers distributed or circulated without our prior written approval are not valid and may be refused or cancelled. If you redeem or attempt to redeem a voucher to which you are not entitled you may be committing an offence.

Zayme Pty Ltd reserves the right to cancel or withdraw any voucher or promotion at any time without notice and without reason. If we refuse a voucher for any reason we will inform you before the order is dispatched to give you the opportunity to cancel the order.

Unless otherwise stated a voucher may be used only by the named recipient, it may only be used as stated on the voucher and not in conjunction with any other offer or voucher. Vouchers cannot be exchanged for cash, gift vouchers, delivery charges (except where stated) or for a whole order.

Certain goods may not be purchased using vouchers.

When a voucher or other promotional offer applies to more than one product, the total value of the promotional offer or discount is split and shared across each applicable product in the correct ratio. If an item or part of the order is returned, then we will refund the relevant correct value.

You agree to indemnify and hold Zayme Pty ltd t/a Cheeky Foods harmless from all liabilities, claims and expenses that arise out of the content you submit, post or transmit Zayme Pty Ltd Websites, or from your use/misuse of the Websites or the use/misuse by any person for whom you are responsible or from your violation of the Terms and Conditions.

Your personal details may be used by Zayme Pty Ltd for market research and statistical analysis. We would also like to contact you occasionally with details of products, services and special offers that may interest you.

To do this we will look at the information provided by you and details of products you buy. If Zayme Pty Lyd acquires or develops other businesses the data may be used by the new business in a similar way. By registering with our service, you accept that your email address may be used to supply you with such information.

These Terms and Conditions and the documents produced in accordance with it comprise the entire agreement between you and Zayme Pty Ltd regarding each order which concludes in a contract. Australian law is the governing law of each contract.
